A deviantart user making a version of another image with a different background can't have rights to that image, as far as I'm concerned. This is a bit different from a 3D render, where the user uploads an out-game model, which in some cases would count as their fanwork.

Be it morally or legally, I don't think anyone who remove the background of an existing character image actually own the transparent image. If two Photoshop experts remove the background of the same image, the result will be the exact same.
